Judge Lacava handed down his judgment today in a hotly contested Serious Injury Application, finding in favour of the worker. The plaintiff was a 46 year old woman, who had suffered a stress related condition following bullying at work. The Serious Injury hearing ran over two days, and evidence was called from a number of doctors. Ultimately, Judge Lacava found the plaintiff to be a “witness of truth”, and accepted that she did indeed suffer a psychiatric injury in connection with her work, which had serious “pain and suffering” as well as economic loss consequences for her.
